Can I Claim Compensation
Roads and Pavements
The responsibility for roads and pavements usually rests with the Local or County Council who have a general duty to maintain to a reasonable standard.
In order to succeed in a compensation claim it is necessary to who that the road or pavement was dangerous to pedestrians due to the Authority failing to inspect and maintain.
Shops
Shops have a duty of care to ensure that customers are kept safe. If you have an accident which is due to something being on the floor that shouldn't be there then the shop may be held liable to pay compensation for any injuries that you suffer, even if the cause of the accident was as a result of another customer's negligence.
Other Premises
The Occupiers Liability Act provides that the occupier of premises is under a duty to take reasonable care to ensure that any visitors are safe. This covers accident in gardens, hotels, factories, offices, sports centres, private homes and any other place that a visitor is invited or permitted to be there by the occupier.
