The Court of Protection makes decisions on financial or welfare matters for people who cannot make decisions for themselves. If someone close to you has lost the mental capacity to make decisions for themselves, and there is no Power of Attorney in place, legally, no one has the authority to take matters into their own hands and deal with their affairs, even spouses. 

In this instance, you can apply to the Court of Protection to be appointed as a deputy, meaning you will be authorised to make decisions on behalf of your friend or relative. If no one is suitable or willing to act as a deputy, the Court of Protection can appoint a professional deputy from an approved panel of deputies.
