Lasting Power of Attorney
We appreciate that it can be difficult for an individual or their family members to plan for the future if you or a loved one becomes unable to make decisions. Therefore, we can provide expert advice concerning the creation of a Lasting Power of Attorney.
By making a Lasting Power of Attorney, you can be certain that any decisions about your finances (or your loved one’s) and your or their health can be made by people you trust implicitly. An attorney can be a family member, a friend, or a professional person. You can choose which decisions your attorneys can make on your behalf.
There are two types of Lasting Power of Attorney available:
Financial Decisions
Your attorneys can make decisions about buying or selling property, paying bills, and investing money.
Health & Care Decisions
Your attorneys can make decisions about your medical care, where you should reside, what activities you take part in, what you should eat, etc.
Lasting Powers of Attorney can only be registered if you are ‘mentally able’ to create one but can come into effect before you are deemed to have lost mental capacity (if indeed you do so).

They could be a relative, partner, friend or professional, for example, a solicitor.
They do not have to be a British citizen or reside in the UK, but they must have the mental capacity to make their own decisions.
When choosing an attorney, think about how well they look after their own affairs and finances, how well you know them and if you trust them to make decisions in your best interest.
There are two types of Power of Attorney:
Property & Financial Affairs
This will allow your attorneys to access your bank accounts, ensure that bills are paid, and deal with your property affairs, which could include the sale of a property.
Health & Welfare
This will allow your attorneys to speak to your doctor as if they were you if you had no capacity to deal with your own health needs.
The Lasting Power of Attorney documents come into effect as soon as the documents are registered with the Office of the Public Guardian. Currently the waiting period for this is 20 weeks.
However, within the Lasting Power of Attorney documents there is a section where you can decide whether they are effective as soon as they have been registered or you can stipulate that the documents should not come into effect until such time that you lose mental capacity.
